Welcome to Roadcourseclub LLC (“we,” “us,” “our,” or “Roadcourseclub”). These Terms of
Service (“Terms”) govern your access to and use of our website www.roadcourseclub.com (the
“Site”), any purchases, sweepstakes entries, and related services (collectively, the “Services”).
By using the Site or Services, you agree to be bound by these Terms. If you do not agree,
do not use the Site.
1. Eligibility
● You must be 18 years or older and a legal resident of the 48 contiguous U.S. states or
D.C. to use the Site or enter sweepstakes.
● You may not use the Site if you are barred from doing so under applicable law.
2. Account Responsibility
● You are responsible for maintaining the confidentiality of your account and password.
● You agree to notify us immediately of any unauthorized use.
● We are not liable for any loss or damage arising from your failure to secure your
account.
3. Purchases & Payments
● All sales are final and non-refundable due to the sweepstakes nature of our
promotions.
● Prices are in USD and exclude taxes, shipping, and handling unless stated.
● We use third-party payment processors (e.g., Stripe). You agree to their terms.
● We may refuse or cancel any order at our sole discretion.
4. Sweepstakes Entries
● Entries earned via purchase are non-transferable.
● No refunds for purchases made during sweepstakes, even if you do not win.
● Mail-in entries must comply with Official Rules.
● We reserve the right to disqualify any entry for fraud, abuse, or violation of rules.
5. Prohibited Conduct
You agree not to:
● Use bots, scripts, or automated means to enter or interact with the Site
● Attempt to gain unauthorized access to our systems
● Interfere with Site functionality or other users
● Misrepresent your identity or submit false information
● Engage in chargebacks with intent to fraudulently obtain entries
● Harass, threaten, or defame others
Violation may result in immediate termination of access, disqualification from
sweepstakes, and legal action.
6. Intellectual Property
● All content on the Site (text, images, logos, videos, designs) is owned by
Roadcourseclub or its licensors.
● You may not copy, modify, distribute, or create derivative works without written
permission.
● User-submitted content (e.g., reviews, photos) grants us a worldwide, royalty-free,
perpetual license to use, display, and promote.
7. User Content
● You are solely responsible for content you submit.
● You represent that your content does not violate third-party rights.
● We may remove any content at our discretion.
8. Disclaimers
● The Site and Services are provided “AS IS” and “AS AVAILABLE.”
● We disclaim all warranties, express or implied, including merchantability, fitness for a
particular purpose, and non-infringement.
● We do not guarantee the Site will be uninterrupted, secure, or error-free.
9. Limitation of Liability
To the fullest extent permitted by law:
● We are not liable for indirect, incidental, special, consequential, or punitive damages.
● Our total liability shall not exceed the amount you paid us in the past 12 months.
● We are not responsible for prize vehicle condition, title issues, or winner’s tax
obligations.
10. Indemnification
You agree to defend, indemnify, and hold harmless Roadcourseclub, its officers, employees,
and agents from any claims, damages, or expenses arising from:
● Your use of the Site
● Your violation of these Terms
● Your sweepstakes entry or conduct
11. Termination
● We may suspend or terminate your access at any time, without notice, for any reason.
● Upon termination, your right to use the Site ceases immediately.
12. Governing Law & Disputes
● These Terms are governed by the laws of the State of Indiana, without regard to conflict
of law principles.
● Any dispute must be resolved exclusively in state or federal courts in Elkhart County,
Indiana.
● You waive any right to jury trial or class action.
13. Sweepstakes Official Rules
● All sweepstakes are governed by separate Official Rules, which are incorporated here
by reference.
● In case of conflict, Official Rules control for sweepstakes matters.
14. Changes to Terms
● We may update these Terms at any time.
● Changes will be posted here with an updated “Last Updated” date.
● Your continued use of the Site after changes means you accept the new Terms.
